BY ACCEPTING AN INVITATION FROM A PARK BANK REPRESENTATIVE, YOU REPRESENT THAT YOU, AS THE AUTHORIZED REPRESENTATIVE OF OUR CUSTOMER: (i) HAVE THE CAPACITY TO BIND OUR CUSTOMER TO THE TERMS OF THIS DISCLAIMER; AND (ii) CONSENT, ON BEHALF OF OUR CUSTOMER, TO BE BOUND BY THIS DISCLAIMER. IF YOU DO NOT AGREE TO ALL OF THE TERMS AND CONDITIONS OF THIS DISCLAIMER, OR DO NOT REPRESENT OUR CLIENT, YOU WILL NOT AND MAY NOT RECEIVE REMOTE ACCESS SUPPORT SERVICES FROM PARK BANK.
The ability for Park Bank to remotely access your computer may significantly enhance Park Banks ability to try and resolve technical problems quickly. However, remote access services are provided by a Park Bank representative at your request and at your sole risk. As such, Park Bank recommends that you remain at your desk and observe the entirely of the remote access support session.
By accepting the invitation from a Park Bank representative, you are representing that you have received permission to share access and control of the computer, network or system with a Park Bank representative, as well as authorizing Park Bank to connect to your computer, system or network. You understand that by requesting such assistance, you will be providing a Park Bank representative with access to remotely view your computer. Be sure to close any confidential or personal files that you may be working on before allowing remote access to your computer. While access to your computer may be subject to confidentiality provisions between Park Bank and our customer, Park Bank does not assume and is not responsible for any liability for the linking and viewing of any desktop content, the operation of the remote-control software or any hardware performance. You are solely responsible for limiting access to information during any remote access session that cannot be disclosed to Park Bank.
It is your responsibility to backup all applications and data prior to the remote session. Park Banks representative is not expected to and will not make any copies or downloads of your applications or data, or retain any information accessed from your computer.
You further agree to accept any and all responsibility and liability for any changes made or data transmitted during periods when you have granted a Park Bank representative access to your computer. PARK BANK SHALL HAVE NO LIABILITY FOR ANY CLAIMS OR DAMAGES RESULTING IN ANY WAY FROM YOUR USE OF THE REMOTE ACCESS SUPPORT SERVICES. PARK BANK AND ITS REPRESENTATIVES MAKE NO WARRANTIES OF ANY KIND WITH REGARD TO THE REMOTE ACCESS SUPPORT SERVICES PROVIDED HEREUNDER. PARK BANK AND REPRESENTATIVES HEREBY DISCLAIM ANY AND ALL WARRANTIES AND CONDITIONS WITH REGARD TO THE REMOTE ACCESS SUPPORT SERVICES INCLUDING WITHOUT LIMITATION ANY AND ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL PARK BANK OR ITS REPRESENTATIVES BE LIABLE FOR (i) ANY SPECIAL, DIRECT, INDIRECT OR CONSEQUENTIAL DAMAGES OR (ii) ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE PROVISION OF REMOTE ACCESS SUPPORT SERVICES.
